1. Acceptance of Terms

By purchasing tickets, visiting our facility, using our mobile application ("5 Points App"), or accessing our website at 5pointshaunt.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or visit our facility.

These terms apply to 5 Points Productions, operated by Jesse McCabe, located at 241 W Roosevelt Rd, West Chicago, IL 60185.

2. Ticket Purchases

2.1 Payment Processing: All ticket purchases are processed through Stripe, a third-party payment processor. We do not store your credit card information.

2.2 Refund Policy: All ticket sales are final and non-refundable except in the event of cancellation by 5 Points Productions. If we cancel an event, you will receive a full refund to your original payment method.

2.3 Ticket Validity: Tickets are valid only for the date and time specified at purchase. Tickets cannot be exchanged or transferred to other dates without prior approval from 5 Points Productions.

2.4 No-Shows: Failure to arrive during your scheduled time slot will result in forfeiture of your ticket with no refund.

3. Liability Waiver Requirement

3.1 Mandatory Waiver: All guests, including spectators, must sign a liability waiver before entering the haunted attraction. By purchasing a ticket, you acknowledge that you will be required to complete this waiver.

3.2 Minors: Guests under 18 years of age must have a parent or legal guardian sign the waiver on their behalf. Minors without a signed waiver will not be admitted, and no refund will be provided.

3.3 Digital Waivers: Waivers can be signed in advance through our website or mobile app to expedite entry.

4. Age Restrictions

4.1 Recommended Age: Our haunted house experience is recommended for guests 13 years of age and older due to intense scares, strobe lights, fog effects, loud sounds, and physical environments.

4.2 Parental Discretion: Parents and guardians should use discretion when bringing children under 13. We are not responsible for psychological distress experienced by minors.

4.3 Guardian Supervision: All minors must be accompanied by a parent or legal guardian who has signed their waiver.

5. Assumption of Risk

By entering our facility, you acknowledge and accept the following risks:

• Strobe lights and lighting effects (may trigger seizures in susceptible individuals)
• Fog, haze, and theatrical smoke effects
• Loud sounds, sudden noises, and screaming
• Live actors in close proximity
• Uneven surfaces, stairs, low ceilings, and narrow passages
• Startling scares and jump scares
• Intense and frightening content
• Walking in darkness and low-light conditions

Medical Conditions: Guests with heart conditions, respiratory issues, epilepsy, pregnancy, or other medical conditions that could be aggravated by the above should not participate. We are not liable for any medical emergencies resulting from your visit.

6. Code of Conduct

To ensure the safety and enjoyment of all guests, you agree to:

• No touching actors: Do not touch, push, grab, or make physical contact with any actors or staff
• Follow staff instructions: Immediately comply with all instructions from our staff and actors
• No alcohol or drugs: Do not enter under the influence of alcohol or drugs; intoxicated guests will be removed
• No weapons: Real or replica weapons are strictly prohibited
• No flash photography: Photography may be prohibited in certain areas for safety reasons
• Respect the environment: Do not vandalize, damage, or remove props or set pieces
• No running: Walk through the attraction at a safe pace

Removal Without Refund: Violation of any conduct rules will result in immediate removal from the premises without refund. We reserve the right to refuse service to anyone.

7. NFC Card Collection & Rewards Program

7.1 Program Overview: Our NFC card collection system allows guests to collect digital cards throughout the attraction and earn rewards.

7.2 No Cash Value: Rewards, points, and collectible cards have no cash value and cannot be exchanged for money.

7.3 Program Changes: We reserve the right to modify, suspend, or terminate the rewards program at any time without notice.

7.4 Account Required: Participation in the rewards program requires a 5 Points mobile app account.

8. Mobile App Usage

8.1 Account Creation: Use of the 5 Points mobile app may require creating an account authenticated through Firebase Authentication.

8.2 Account Security: You are responsible for maintaining the security of your account credentials. Notify us immediately of any unauthorized access.

8.3 Acceptable Use: You agree not to use the app for any unlawful purpose, to impersonate others, or to interfere with the app's functionality.

8.4 Termination: We reserve the right to suspend or terminate your account for violation of these terms.

9. Intellectual Property

All content on our website, mobile app, and within our attractions—including text, graphics, logos, images, videos, and audio—is the property of 5 Points Productions and is protected by copyright and trademark laws.

9.1 Limited License: You are granted a limited, non-exclusive, non-transferable license to use our services for personal, non-commercial purposes.

9.2 Prohibition: You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content without our express written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 5 POINTS PRODUCTIONS, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Your use of or inability to use our services
• Any physical or psychological harm sustained during your visit
• Lost or stolen property
• Errors or omissions in our content or services
• Unauthorized access to or alteration of your data

YOUR SOLE REMEDY FOR DISSATISFACTION WITH OUR SERVICES IS TO STOP USING THEM.

11. Dispute Resolution

11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

11.2 Venue: Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in DuPage County, Illinois.

11.3 Informal Resolution: Before filing any claim, you agree to contact us at contact@5pointshaunt.com to attempt to resolve the dispute informally.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.
